BT FABRICATION – LIGHT TOWER DISCLAIMER

DISCLAIMER & LIMITATION OF LIABILITY

BT Fabrication LLC (“BT Fabrication”) manufactures truck bed–mounted light towers for commercial, industrial, and recreational use. By purchasing, installing, or using this product, you agree to the following terms:
    1.    Proper Use Required
This product must be installed, wired, and operated in accordance with all provided instructions, applicable laws, and industry safety standards. Improper installation or use may result in property damage, injury, or death.
    2.    User Responsibility
The purchaser, installer, and operator are solely responsible for ensuring:
    •    The vehicle can safely support the tower
    •    All electrical connections are properly protected and fused
    •    The tower is fully retracted and secured before the vehicle is in motion
    •    The operator maintains awareness of overhead hazards (e.g., power lines, branches, structures)
    •    The tower is used only on stable ground and in safe conditions
    3.    No Liability for Misuse or Modifications
BT Fabrication is not responsible for damages, injuries, or losses caused by:
    •    Incorrect installation
    •    Unauthorized modifications or alterations
    •    Improper wiring or electrical misuse
    •    Operation by untrained personnel
    •    Use outside intended purposes
    •    Failure to follow warnings or instructions
    4.    Electrical Safety
The operator must comply with all electrical safety standards when using 12-volt or 110-volt power. Overloading, improper extension cords, or unprotected circuits may cause fire or damage. BT Fabrication is not responsible for electrical hazards created by the user.
    5.    Environmental & Working Conditions
This equipment must not be used in extreme weather or conditions where the tower cannot be securely anchored or safely operated. Wind load, terrain, and environmental factors must be assessed by the user.
    6.    Inspection & Maintenance
Regular inspection is required. The user must check all welds, bolts, electrical connections, and mechanical components before each use. Any abnormal wear, damage, or malfunction must be addressed immediately. Continued use after damage voids all warranties.
    7.    No Guarantee of Illumination Coverage
Light output, visibility, and illumination performance vary based on environment, mounting location, and user setup. BT Fabrication does not guarantee lighting results for any specific job, task, or worksite.
    8.    Limited Warranty
BT Fabrication provides a limited warranty covering manufacturing defects in the tower structure. Light manufacturers (e.g., FCK Light Bars, RoadShock, Nilight) provide their own separate warranties. BT Fabrication is not responsible for third-party lighting products.
    9.    Limitation of Damages
To the fullest extent permitted by law, BT Fabrication is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:
    •    loss of income
    •    downtime
    •    equipment damage
    •    personal injury
    •    property damage
    •    business interruption
arising from the installation, use, or inability to use this product.
    10.    Assumption of Risk
By using this product, the user acknowledges and accepts all risks associated with elevated lighting equipment and agrees to operate it safely and responsibly.
